Abstract

 

Islamic commercial jurisprudence provides a comprehensive ethical and legal framework for regulating economic activities and business relationships. Its objective is not merely to determine the validity or invalidity of individual contracts but also to establish justice, transparency, mutual consent, protection of wealth, and social welfare. The rapid transformation of contemporary business through e-commerce, digital payments, installment sales, corporate structures, online marketing, electronic contracts, and Islamic financial products has created new commercial situations that require careful juristic analysis. This study examines the basic principles of Islamic commercial jurisprudence and evaluates their application to contemporary business practices. Particular attention is given to mutual consent, prohibition of riba, gharar and maysir, honesty and disclosure, lawful ownership, contractual certainty, consumer protection, and ethical marketing. The study argues that Islamic law possesses sufficient conceptual flexibility to address emerging commercial practices, provided that new forms are examined in the light of established Shariah principles rather than merely by their names or outward appearances. The contemporary application of Islamic commercial jurisprudence therefore requires a balanced approach combining classical juristic principles with a proper understanding of modern economic realities.
