The Jurisprudential Questions from The Companions (Women) To The Prophet Muhammad (Peace Be Upon Him) Regarding Inheritance Issues and Their Contemporary Application

Abstract

Inheritance rules in Islamic law are of great importance and are based on the Quran and Sunnah. The jurisprudential awareness of the women Companions in early Islamic society and their questioning of the Prophet (peace and blessings of Allaah be upon him) is not only a manifestation of their intellectual taste but also illustrates their active role in the formulation and understanding of Islamic law. This study presents an analysis of the questions of the women Companions regarding inheritance issues and the Prophet’s (peace and blessings of Allaah be upon him) answers to them. At the same time, this study sheds light on the meaning and application of these questions in the modern era. Keeping in mind the current issues such as the violation of inheritance rights, the increasing trend of depriving women of their Shariah share and the distance from Islamic teachings in this regard, this article has shown that the practical examples of the early women Companions can become a source of guidance for today’s Muslim society. This study emphasizes the need for effective application of inheritance laws in the modern era in the light of jurisprudential reasoning, the spirit of Shariah, and the principles of justice and equality.
