Abstract

(A) The literal meaning of Qisas is similarity. The meaning here is that it is permissible for the other person to take revenge as much as the wrong done to him, but it is not permissible to do more than that. Therefore, Allah Almighty says: By the same token, "may he abuse you, so abuse him as much as he has abused you." In another place, Allah Almighty says that if you start taking revenge, then take revenge as much as the wrong done to you. From these two verses, it is known that retribution is the name of the punishment in which there is similarity.

(B) In qisas, the criminal will be killed when he has committed the crime intentionally, so it is said in a hadith: Man killing intentionally is Fahqud, that is, what has been killed intentionally is the punishment of qisas.
